Defending Against Criminal And Traffic Offenses In The Roselle Municipal Court

The Roselle Municipal court only presides over Offenses, not Crimes. Under New Jersey Law, “Crimes” and “Offenses” are two different things, and if you have committed a “Crime”, your case must be heard in County Court, but if you have committed an “Offense” your case will be heard in Municipal Court. The most common Offenses are disorderly persons offenses, a conviction of which results in a maximum of 6 months in prison. Examples of common disorderly persons offenses heard in the Roselle Municipal Court include Shoplifting, Disorderly Conduct, Resisting Arrest, Simple Assault, Trespass, and some Drug Charges like Possession of less than 50 grams of Marijuana or Drug Paraphernalia. The Roselle Municipal court also presides over most traffic offenses such as DUI/DWI, Driving while Suspended or Revoked, Speeding, Reckless Driving, and Leaving the Scene of an Accident.

Roselle Municipal Court

A Municipal Court has its name because there is one located in every municipality. Thus, the Roselle Municipal Court is located in the Roselle Municipality. A municipality is like a town or small city, and it usually has its own mayor, city council, or municipal council. In Roselle, the governing body is the borough council which consists of a mayor and six other members. Each member serves a three-year-term, and voting is staggered so every year, two members are elected. There is one Municipal Court in every municipality in New Jersey, making a total of 539 municipal courts throughout the state. Additionally, every municipality has its own local laws, and a violation of those laws would also be heard in Municipal Court along with Offenses.
