Aggressively Representing Those Facing Criminal Charges In Linden
The land on which Linden, New Jersey sits was first explored over 400 years ago, but the first hints of community life did not develop until 1745 when the townsfolk began to gather around Wheatsheaf Tavern. During Colonial times, taverns often substituted as common gathering places for local affairs.
Today, Linden has a population of over 40,000, and there are many taverns scattered throughout the city. Unfortunately, with the development of all these modern taverns, which are visited primarily for drinking purposes, the Linden Municipal Court is often flooded with DUI/DWI offenses. My name is Anthony N. Palumbo, Local Union County Lawyer and New Jersey Criminal Defense Attorney, and I have successfully defended individuals against DUI/DWI charges in the Linden Municipal Court for over 35 years.
Other common offenses heard in the Linden Municipal Court include Reckless Driving, Careless Driving, Possession of Drug Paraphernalia, Bad Checks, Leaving the Scene of an Accident, Shop-lifting, and Driving with a Revoked or Suspended License.
If you or a loved one has been charged with an offense or has received a criminal charge, traffic summons, ticket or complaint in Linden, The Law Offices of Anthony N. Palumbo strongly recommends that you contact a knowledgeable and experienced attorney immediately who will protect your rights, your freedom and your reputation. Contact me today at 1-866-664-8118 for a free initial consultation by phone or in person at one of my two conveniently located offices in Cranford and Elizabeth, New Jersey.

DUI/DWI Offenses In Linden
DUI/DWI is one of the most common offenses heard in the Linden Municipal Court. Penalties for DUI/DWI vary depending on the level of intoxication at the time of arrest, and whether the individual has previously been convicted of a DUI/DWI. Whatever the circumstances of your DUI/DWI, an experienced lawyer will be able to identify which defenses will best work on your behalf. Consideration of defenses involves both the particular circumstances of your case, but may also depend on the plausibility of the defense given the legal customs of the local officials. As a lawyer with extensive experience defending individuals charged with criminal offenses and traffic summons in Linden for over 35 years, I can easily identify which defenses will work for you.
DUI/DWI 1st-Time Offense:
Penalties for a first time offense depend on your Blood Alcohol Concentration (“BAC”) and whether you were using drugs in addition to alcohol.
If your BAC was between .08 and .09 and no drugs were involved, you can expect:
- A fine of $250-$400
- Detainment 12 to 48 hours
- Jail up to 30 days
- 3 month license suspension
If your BAC was .10 or higher OR you were using drugs, you can expect:
- A fine of $300-$500
- Detainment 12 to 48 hours
- Jail up to 30 days
- License suspension between 7 months and 1 year
If this was not your first offense, a conviction of a second offense will lead to greater penalties. However, this does not mean that defenses are not available to your charge. There are many defenses that can be utilized on behalf of someone charged with a DUI/DWI. For example, an experienced lawyer may be able to show that the evidence of your BAC was not properly obtained or was not taken by a qualified individual. If such a defense can be successfully proven, the charges against you may be dropped. Linden Municipal Offenses
DUI/DWI is not the only offense heard in the Linden Municipal Court. In New Jersey, a Municipal Court has jurisdiction over all non-indictable offenses. These include a variety of other traffic violations like speeding, reckless driving, failure to stop, improper lane change, driving without insurance, driving with a suspended or revoked license, or failure to report an accident. In addition to traffic violations, the Linden Municipal Court also has jurisdiction over minor criminal offenses like possession of less than 50 grams of marijuana, possession of drug paraphernalia, certain types of Lewd Conduct, and Simple Assault. More serious offenses are heard in County Criminal Court. The upside to Municipal Court is that the maximum penalty that can be imposed against you is six months in prison because that is the maximum penalty for all non-indictable offenses in New Jersey.

Municipal Court Judges
A Municipal Court is presided over by a judge. This means that there is not a jury that decides the outcome of your case in Municipal Court, but rather your charge and the penalties will be determined by a judge. Some people feel that this is a disadvantage of the Municipal Court system, but there is a steep upside to having a judge preside over your case. Judges are often more objective than juries, and are more likely to impose penalties based on the law instead on wild emotion derived from personal experience. Therefore, the penalties imposed by a judge are often more reasonable than those imposed by a jury, and this may be beneficial to your case. In the Linden Municipal Court, the judicial officials include, the Presiding Judge, the Honorable Louis M.J. DiLeo, and Court Administrator, Elizabeth Gavigan.
