Lawmakers seek to expand consequences of New Jersey DUI laws

New Jersey has stringent laws that govern driving under the influence allegations. A person accused of drunk driving can face a suspension of the privilege to drive, as well as charges in court. DUI offenses involve many different types of issues.

Like any criminal offense, constitutional principles are an important consideration for DUI defense lawyers to analyze. Looking for flaws in the evidence itself is important. Scientific tests, such as a breath test, can be inaccurate or suspect based upon how the test was administered.

While current laws provide a variety of potential consequences upon conviction of DUI, lawmakers in New Jersey are considering modifying the DUI statutes to expand the use of ignition interlock devices in DUI cases. In 2010, New Jersey lawmakers made the use of ignition interlocks mandatory in DWI cases involving a breath-test refusal, and in high alcohol cases – anyone convicted of DUI with an alcohol concentration of 0.15 percent blood alcohol concentration may need to install an ignition interlock under current law.

Two Union County lawmakers have proposed bills that seek to make the DUI laws tougher, with increased fines, potential jail time, expanded use of ignition interlock devices and other heightened consequences.

An ignition interlock device is essentially a portable breath testing machine that is hooked into the car’s ignition system. To start the car, a driver must pass a breath test. These devices come with costs that can increase the expenses involved with a DUI conviction. A New Jersey DUI defense lawyer may analyze an individual DUI arrest and present a defense in court.
