Belmar Traffic Ticket Defense Lawyer

Traffic Violation Attorney, Monmouth County

All too often, people ticketed for traffic offenses plead guilty without fully considering the consequences. While pleading guilty and paying a fine may seem like the easiest option at the time, a moving violation can easily result in increased insurance costs and require attendance at a New Jersey traffic school. The points on your license for pleading guilty could also set you up for future license suspensions if you get another traffic ticket later on. Many of these penalties can be reduced or avoided with the help of an experienced traffic ticket defense lawyer, but once a guilty plea is entered it usually can't be withdrawn. Don't let this happen to you -always speak with an attorney before deciding whether to plead guilty to a traffic ticket.

I am Anthony N. Palumbo, New Jersey Traffic Ticket Defense Attorney, and I routinely assist clients with all types of traffic offenses and driving violations, including charges for speeding, reckless driving, driving without insurance, driving with a suspended license, leaving the scene of an accident, running a stop sign or red light, assault by auto, and driving while intoxicated. I've been a Belmar traffic ticket defense attorney for more than 35 years and I have a longstanding reputation in the legal community for obtaining dismissals, getting points eliminated or reduced, and getting fines severely diminished. Instead of pleading guilty, call me today for a free legal consultation at 1-866-664-8118.

Speeding Tickets

In order for the prosecution to obtain a conviction for speeding, it must be shown that the speed limit posted on the sign was in accordance with the state speeding laws. A common defense is to show that the state, county, or municipality never approved the speed limit on the sign. If a New Jersey Speeding Ticket Attorney is successful in demonstrating this deviation, then the speeding charges must be dropped. Another common defense is to challenge the procedures that the police used in obtaining radar or laser evidence. An experienced defense attorney can also get your speeding violation dismissed or downgraded to a lesser charge by raising constitutional challenges and other procedural or trial errors.

On the other hand, pleading guilty to a speeding ticket without consulting a lawyer will leave you with the entire fine and get you up to 5 points on your license (and possibly up to 10 points if you were also charged with reckless driving). Because you only need 12 points to have your license suspended, this can have significant consequences if you get charged with another traffic violation later on.

Failing to Obey Traffic Signals

Violations for failing to observe traffic signals, failing to observe stop signs, and failing to yield at an intersection or right of way will result in points on your license and penalties including up to 15 days in jail and fines of up to $200. As with speeding tickets, however, there are a number of different defenses that can be argued to get your charges reduced or dismissed. For example, an experienced traffic ticket defense lawyer may be able to have your charges dropped by proving that you failed to stop because the sign was hidden behind trees or because the traffic light was defective or broken.
