NJ Drug Distribution Penalties

If you are convicted of Possession of Drugs with Intent to sell, the penalties depend on: (1) the type of drug; and (2) the amount involved. The following provides the penalties applicable to Possession with Intent to Distribute Cocaine and Possession with Intent to Distribute Marijuana. These are two extremely common charges.

Possession of Cocaine with Intent to Distribute

Possession with Intent to Distribute 5 ounces or more of cocaine, results in a 1st degree crime which carries 10 to 20 years in prison and up to $500,000 in fines. Under 5 grams but more than ½ of an ounce, results in a 2nd degree crime which carries 5 to 10 years in prison, and less than ½ of an ounce, results in a 3rd degree crime and up to $75,000 in fines.

Possession of Marijuana with Intent to Distribute

Possession with Intent to Distribute 25 pounds or more of marijuana, or 50 or more marijuana plants, results in a 1st degree crime which carries 10 to 20 years in prison and up to $300,000 in fines. 5 or more pounds of marijuana, but less than 25 pounds of marijuana, or between 10 and 49 marijuana plants, results in a 2nd degree crime which carries 5 to 10 years in prison. 1 ounce or more of marijuana, but less than 5 pounds of marijuana, results in a 3rd degree crime which carries 3 to 5 years in prison and up to $25,000 in fines. And less than 1 ounce of marijuana, results in a 4th degree crime which carries up to 18 months in prison.
