If you have been charged with driving while suspended, the penalties you face may vary based on whether this is your first or subsequent offense, the reason your license was originally suspended, and the circumstances under which you were charged. The following is a general overview of the penalties faced by first, second, and third offenders.

  • First Offense: If you plead guilty without consulting an attorney you will face a $500 fine, up to 6 months additional license suspension, and a $250 M.V.S. charge once a year for three years.
  • Second Offense: If you go to court and admit to the offense without speaking to an attorney, you will face a $750 fine, up to 6 months additional license suspension, 1-5 days in jail, and $250 M.V.S. charge once a year for three years.
  • Third Offense: If you enter an admission of guilt without consulting an attorney, you will face a $1000 fine, up to 6 months additional license suspension, 10 days in jail or SLAP program, and $250 M.V.S. charge once a year for three years.

Facing Enhanced Penalties
The penalties for driving while suspended can be enhanced depending on the reason your license was originally suspended. For example, if your license was originally suspended because you were in an accident and someone was injured in the accident, the penalties may include 45 days in jail in addition to the other penalties set out above.

Suspended for DUI
If your license was originally suspended because of a DUI, you will face an additional 1-2 year license suspension and you may also go to jail for 10 to 90 days. An avid defense can seriously reduce the penalties you face even if your license was originally suspended for a DUI. Driving while suspended is a municipal offense and is heard by the Clark municipal Court. The Clark Municipal Court is located at 315 Westfield Avenue in Clark, New Jersey 07066.
