Understanding Child Pornography Charges

In order to be convicted of possession of child pornography, you must knowingly possess or look at an image, film or photograph that shows a child in a prohibited sexual act or simulated act, including Internet viewing.

Possession of Child Pornography is a serious crime and if convicted, you will be sentenced to up to 18 months in prison and pay up to $10,000 in fines.

In order to be convicted of distribution of child pornography, it must be proved you:

  • Received for the purpose of selling or knowingly sell, procure, manufacture, give, provide, lend, trade, mail, deliver, transfer, publish, distribute, circulate, disseminate, present, exhibit, advertise, offer or agree to offer, through any means, including the Internet
  • Any photograph, film, videotape, computer program or file, video game or any other reproduction or reconstruction
  • Showing a child engaging in a prohibited sexual act or in the simulation of such an act

If you are convicted of distribution of child pornography, you could be sentenced to 5 to 10 years in prison and pay up to $250,000 in fines.
