Public Park & Housing Law

In addition to the basic penalties for drug distribution or manufacturing, you could be facing another 3 to 10 years in prison if you were caught distributing, manufacturing, or selling CDS within 500 feet of a public park, public housing project, or public building.

Manufacturing or selling CDS in a public park or housing zone is a second degree crime, subject to 5 to 10 years in prison, unless the violation involves less than an ounce of marijuana, in which case it's a third degree crime, subject to 3 to 5 years in prison. There are similar enhanced penalties for distributing, manufacturing, or selling CDS in a school zone.

Defending the Charge

Unfortunately, it's not a defense to charges for manufacturing or distributing CDS near a public park, housing facility, or building that you were unaware of the location. However, there are viable defenses against this charge. One defense is that the you did not have the intent to distribute the CDS for profit and the situation did not involve distribution to someone under the age of 17. Dismissal of this charge alone can make a huge difference in the penalties you face, so it's important to choose an attorney who's familiar with these defenses.
