In New Jersey, under applicable statute N.J.S.A. 2C:35-10, it is illegal for someone to knowingly possess a controlled dangerous substance ("CDS") unless it was obtained by a valid prescription. Cocaine is considered a Schedule II CDS, and simple possession is a Third Degree Crime which carries up to 5 years in prison if convicted, and an additional fine of $35,000 can be imposed in such cases. Distribution of Cocaine

In New Jersey, under applicable statute N.J.S.A. 2C:35-5, it is unlawful to possess cocaine with the intent to distribute. Penalties vary based on the amount of cocaine at issue. The following is a layout of the charges relating to different amounts of cocaine, and the penalties that result on conviction.

  • Five ounces or more is a First Degree Crime which carries penalties of 10 to 20 years in prison and a $500,000 fine.
  • One-half ounce or more, but less than five ounces is a Second Degree Crime which carries penalties of 5 to 10 years in prison if convicted.
  • Less than one-half ounce is a Third Degree Crime which carries penalties of 3 to 5 years in prison and a fine of up to $75,000.
