Woodbridge DUI

Arrested for DUI in Woodbridge

When a person is pulled over for drinking and driving in Woodbridge, there are often reliability problems with breathalyzer tests and refusal and field sobriety tests that officers administer in drunk driving arrests. Lately, a new problem involving DUI/DWI, and breathalyzer refusals has been raised for people who do not speak English. There are 1.75 million Spanish immigrants who reside in New Jersey and many of them do not speak English. Currently, there is not a law that requires police to inform non-English speaking people that they are required to submit to breathalyzer tests in their native language. A DWI case before the New Jersey Supreme Court involves a defendant who does not speak English and who did not understand a police officer's instruction to take a breathalyzer test during a DUI traffic stop. The defense's argument is that the defendant should only be charged with the DUI, but not refusal to submit to a breathalyzer because he did not know he was refusing.

In New Jersey, drivers are required to submit to breath and blood tests because they have been deemed to consent simply by driving on the state's roadways. At the traffic stop in the drunk driving case above, the police officers asked the defendant to produce his license, registration, and insurance in English, but he did not respond. When they asked him in Spanish he provided the documents. The officer on the scene smelled alcohol and asked the defendant to perform a field sobriety test. The defendant did not comply because he did not speak English. The officer then arrested him and he was charged with DUI and refusal.
