Middlesex County Indictable Crimes

The Middlesex County Courthouse is a Superior Court that presides over crimes and indictable criminal offenses. In most states, criminal offenses are divided between felonies and misdemeanors, but in New Jersey they are divided between indictable offenses and non-indictable Offenses. Indictable offenses are more serious and involve a charge to the 1 st, 2 nd, 3 rd, or 4 th degree. When a person is charged with an indictable offense in New Jersey, the state prosecutor is notified and is required to decide whether to have a Grand Jury review the evidence and make a decision on issuing an indictment.

The Grand Jury may decide that there is not enough evidence to indict the accused or it may issue an indictment at which time an arraignment would be scheduled, commencing the criminal case. There are many stages of a criminal case that follow the arraignment such as pre-trial hearings, discovery proceedings, depositions, plea hearings, trial, and if possible appeal. Middlesex County Offenses

In addition to Indictable criminal offenses, I also defend individuals charged with non-indictable offenses. These are less serious crimes such as disorderly persons offenses or a Petty disorderly persons offenses for which there is a maximum sentence of 6 months in prison if a conviction results. Non-indictable offenses are not heard in the Middlesex County Superior Court as are indictable criminal offenses, but instead are heard in the Municipal Court.
