New Jersey Plea bargains

A plea bargain is an agreement between the defense and prosecution in which the defendant agrees to certain consequences in exchange for reduced charges or reduced penalties. As bargaining chips, the defendant's attorney will use the strong aspects of the defendant's case to obtain a lesser charge. For example, if the defendant is a first time offender, or a stand up citizen, these facts may be used to negotiate for lesser charges. Another example might be if the defendant's rights were violated, but it is not likely that the violations will result in acquittal. In such a case, the defense may use the violation as a bargaining tool to negotiate for lesser penalties.

Trial vs. Plea Bargain

Only an experienced attorney can make the right decision as to whether a defendant will be best served by a trial or a plea bargain that is why it is so important to have an experienced lawyer by your side. Additionally, the client must agree to negotiate.
