Which Records Can Be Expunged?

Records that may be expunged include all documents surrounding detection, arrest and the criminal process which follows including custody, indictment, trial and conviction. Additionally, all records held by the police department, prosecution and prison may be expunged. Examples of these documents include case records, rap-sheets, complaints, warrants, mug-shots, and even fingerprints.

Can Anyone View My Expunged Records?

The reason why these records are not completely destroyed is because there are exceptional situations in which they can be accessed. Expunged records can be accessed if you are applying to work for a law enforcement agency or judicial branch of government. Another situation in which the records would be accessed is if a person is seeking a conditional discharge or some other alternative sentencing after they've previously been convicted of a criminal offense. In such a case, the presiding judge would have access to your past conviction.
