FAILURE TO STOP PENALTIES

If you receive a traffic ticket or citation for failure to stop and you are convicted or enter a guilty plea the penalties are as follows:

  • Up to 15 days in jail
  • Up to a $200 fine
  • Points on your license
  • Car Insurance Points

The penalties may be increased if you have prior violations, or are charged with another traffic offense while awaiting the resolution of your ticket.

Point System Overview

A guilty plea or conviction for the following offense will result in 2 points on your license.

  • Failure to observe a traffic signal
  • Failure to stop for a police signal
  • Failure to yield at an intersection
  • Failure to observe stop signs
  • Failure to yield right of way
  • Failure to yield to pedestrian crosswalk

FAILURE TO STOP DEFENSES

There are a number of different defenses that can be argued on your behalf if you receive a ticket or citation for failure to stop. For instance, an experienced attorney may be able to have the charge against you dismissed by proving that you did not receive the signal to stop because of some defect with the sign or traffic light.

  • Stop sign: If you failed to stop at a stop sign your attorney may argue that it was hidden behind trees, defaced, or blocked by some other object so that it was not visible from the road.
  • Traffic Light: If you ran a traffic light, your attorney may defend your case on grounds that the light was defective, broken, or blocked by some object so that it was not visible from the road.
